Acceptance of These Terms

These Terms and Conditions ("Terms") are an agreement between you and CourtMix ("CourtMix", "we", "us"). They govern your use of the CourtMix website at courtmix.net, our court and business directory, business dashboard, subscriptions, and related services (together, the "Services").

By using the Services, you agree to these Terms. If you use the Services on behalf of a business, you agree to these Terms for that business and represent that you have the authority to do so. If you do not agree, do not use the Services.

Who Can Use the Services

You must be at least 18 years old to create a CourtMix account or use the Services. You may browse public directory pages without an account.

Your Account

You can create an account with an email address and password or by signing in with Google. You agree to:

  • Provide accurate, current information and keep it up to date
  • Keep your sign-in credentials confidential
  • Accept responsibility for all activity under your account
  • Notify us promptly if you believe your account has been compromised

Business accounts may include staff members. The business is responsible for the actions of everyone it invites to its account.

Business Subscriptions

New paid enrollment and free trials are closed. CourtMix does not currently offer a new paid subscription. Tool concepts shown on the pricing page or elsewhere are product research, not an offer to sell a subscription or a promise to provide specific features.

If your business already has an active paid subscription from an earlier enrollment, these terms continue to govern that subscription until it ends. Existing subscription records may use these plan names and prices:

  • Free listing access: $0. Approved business listing tools and available inquiry information.
  • Legacy Growth subscription: $29 per month, or $23 per month billed annually.
  • Legacy Premier subscription: $79 per month, or $63 per month billed annually.

Amounts are in U.S. dollars and exclude any applicable taxes. The legacy prices above describe existing subscription records and are not available for new purchase.

Free Trials

New free trials are not available. If an existing subscription is still in a trial that began before enrollment closed, the trial terms presented when that business enrolled continue to apply. The business will not be charged if it cancels before that trial ends. If it does not cancel, its existing subscription begins and its payment method is charged when the trial ends.

Billing and Auto-Renewal

Payments for existing paid subscriptions are processed by Stripe. An existing subscription renews automatically on its current monthly or annual interval, and the payment method is charged at the start of each billing period until the subscription is canceled. Existing annual subscriptions are billed upfront. Closing new checkout does not cancel an existing subscription.

Cancellation and Refunds

An existing paid subscriber can cancel through the billing portal in the dashboard (Billing → Manage Billing). Cancellation takes effect at the end of the current billing period. The business keeps its existing subscription access until then and will not be charged again. We do not provide prorated refunds for partial billing periods, except where required by law.

Failed Payments

If a payment for an existing subscription fails, we will notify the business and Stripe may retry the charge. Existing subscription access remains active during a grace period (currently about 14 days) so the payment method can be updated. If payment is not resolved by the end of the grace period, the account moves to free listing access. Its data is retained, but a new paid subscription cannot be started while enrollment is closed.

Plan and Price Changes

An existing subscriber may use the options CourtMix makes available in the Stripe billing portal. Ending an existing subscription does not create a right to start a new paid subscription while enrollment is closed. If we change an existing subscription price, we will give affected subscribers at least 30 days' notice, and the new price applies starting at the first renewal after the notice period.

Business Claims and Listings

Businesses can claim listings in the CourtMix directory. By submitting a claim, you represent that you are authorized to act on behalf of the business you are claiming. We may ask you to verify that authority (for example, through website verification), and we may approve, reject, or later revoke any claim at our discretion — including when a claim turns out to be inaccurate, disputed, or fraudulent.

If you manage a listing, you agree to keep its information accurate and not misleading. We may review, edit, moderate, suppress, or remove any listing at any time, including while a claim or dispute is under review. A listing in our directory is not an endorsement by CourtMix.

Content You Submit

You may submit content to the Services — for example, place suggestions, listing details and updates, and business images or logos. You retain ownership of your content. By submitting it, you grant CourtMix a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt (for example, resizing images), publish, and display that content in order to operate, improve, and promote the Services.

You represent that you have the rights to the content you submit and that it does not infringe anyone else's rights or violate any law. We review suggestions before publishing them and may edit, decline, or remove any submitted content at our discretion.

Leads and Consumer Inquiries

Visitors can send inquiries to businesses through the Services, which may include the visitor's name, email address, phone number, and message. If your business receives this lead information, you may use it only to respond to that inquiry and for reasonable follow-up about it. You agree to:

  • Comply with applicable law when contacting leads, including laws governing commercial email, texts, and calls (such as CAN-SPAM and the TCPA)
  • Not sell, share, or disclose lead information to third parties
  • Not add leads to marketing lists without their consent
  • Handle lead information securely and delete it on request

We may suspend lead delivery or terminate accounts that misuse lead information.

Directory Information — No Guarantees

Court and place information in our directory is compiled from public sources, business submissions, and community contributions. We work to keep it useful and current, but it is provided "as is": we do not guarantee that details like court availability, surfaces, hours, fees, access rules, or amenities are accurate or up to date. Verify important details with the venue before visiting.

CourtMix does not own or operate the venues listed in our directory and is not responsible for conditions at any location. Playing sports involves inherent risk of injury — you visit venues and participate in physical activity at your own risk.

Promoted Placement

An existing paid subscription may include enhanced or promoted placement in search results and directory pages. Promoted placement affects where a listing appears, not the accuracy standards it must meet, and is labeled as promoted or sponsored where required.

Acceptable Use

You agree not to:

  • Scrape, crawl, or bulk-extract directory data, or use the Services to build a competing dataset or directory
  • Claim a business you are not authorized to represent, impersonate any person or business, or submit false or misleading listing information
  • Submit spam, fraudulent inquiries, or content that is unlawful, infringing, or abusive
  • Interfere with the Services, probe or circumvent security or rate limits, or access them by automated means except through interfaces we provide
  • Use the Services for any unlawful purpose

Our Intellectual Property

The Services — including the CourtMix name, logo, design, software, and the selection and arrangement of the directory — are owned by CourtMix or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services as intended by these Terms. No other rights are granted.

If you send us feedback or suggestions about the Services, we may use them without restriction or compensation.

Copyright Complaints

We respect intellectual property rights and expect the same of our users. If you believe content on the Services infringes your copyright, send a notice to support@courtmix.net that includes: (1) identification of the copyrighted work; (2) the URL or location of the allegedly infringing material; (3) your contact information; (4) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; (5) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; and (6) your physical or electronic signature. We will review complete notices and remove or disable access to infringing material as appropriate, and may terminate the accounts of repeat infringers.

Disclaimer of Warranties

The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or secure, or that directory information will be accurate or complete.

Limitation of Liability

To the maximum extent permitted by law, CourtMix will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from your use of the Services.

To the maximum extent permitted by law, CourtMix's total liability for all claims relating to the Services is limited to the amount you paid us in the 12 months before the claim arose, or $100 if you have not paid us anything. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

If you use the Services on behalf of a business, you agree to indemnify and hold harmless CourtMix from claims, damages, and expenses (including reasonable attorneys' fees) arising from your listing content, your business claims, your use of lead information, or your violation of these Terms or applicable law.

Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules.

If you have a dispute with us, contact us first — most issues can be resolved informally. You agree to give us 30 days to work toward a resolution before filing a claim. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Denver County, Colorado, and you consent to their jurisdiction.

Termination

You can stop using the Services or close your account at any time. We may suspend or terminate your account or access to the Services if you violate these Terms, misuse the directory or lead data, or if required to protect the Services or our users. If we terminate a paid subscription without cause, we will refund the unused portion of any prepaid period. Sections that by their nature should survive termination — including content licenses, disclaimers, limitations of liability, and indemnification — survive.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will give notice — by email to account holders, a notice on the website, or both — before the changes take effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, stop using the Services and cancel any subscription before they take effect.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and CourtMix regarding the Services.
